By using Best Online Hosting services and products you are agreeing to our terms and conditions of use as shown below.
You agree that you will not use our servers in any manner which infringes any laws or which infringes the rights of any third party. You will not post, link to or transmit any material which is unlawful, threatening, abusive, obscene, pornographic or otherwise objectionable in any way.
You will not transmit any material containing a virus or other hostile computer program or which infringes any patent, trade mark, copyright or any other intellectual property rights of any person which may subsist under the laws of any jurisdiction.
You will not send unsolicited email or any form of bulk email from our network. Nor will you promote a site hosted on our network using bulk email.
You will not employ programs which consume excessive system resources, including but not limited to processor cycles and memory. We reserve the right to remove any material which we deem inappropriate from your web site without notice. We do NOT host Warez, Adult or illegal MP3 content.
You must keep secure any passwords and other confidential information relating to your account and shall notify us immediately of any suspected unauthorised use of your account or breach of security including unauthorised disclosure of your password or other security information.
We give no warranty as to the accuracy or quality of information received by any person via our servers and we shall have no liability for any loss or damage to any data stored on the Server. It is your responsibility to maintain adequate insurance cover in respect of any loss or damage to data stored on our servers. While we will use every reasonable endeavor to ensure the integrity and security of our servers, we do not guarantee that the Server will be free from unauthorised users or hackers and we shall be under no liability for failure or misrouting of email or for any other failure in the transmition of data.
You shall observe the procedures which we may from time to time prescribe and shall make no use of our servers which is detrimental to our other customers. All mail sent via your account must be in accordance with applicable legislation (including data protection legislation) and be transmitted in a secure manner.
You warrant that you are at least 18 years of age and that our hosting services will not be used by anyone under the age of 18 years.
We shall use our reasonable endeavors to make available to you at all times the services but we shall not, in any event, be liable for interruptions in service or down-time of servers.
We have the right to suspend the services at any time and for any reason without notice. Accounts can be terminated permanently if customers are found to be hosting illegal content, Adult content, using our server to send Spam email or using our services in a way that constitutes a breach of our terms and conditions. Payment will not be refunded if we terminate your service due to a breach of our terms and conditions.
All charges payable by you for our services shall be in accordance with the rates published on our web site and shall be due and payable in advance of our service provision. We reserve the right to change pricing at any time although all pricing is guaranteed for the period of pre payment. Payment is due each anniversary of the hosting period either monthly, or yearly following the date the services were ordered until cancellation notice is given.
If your bandwidth quota is exceeded in any month you will be liable for additional bandwidth charges for that month. We will contact you requesting payment for the extra bandwidth, we may suspend your account services until this sum has been paid. We offer Add-On Bandwidth to be purchased on our website and recommend purchasing this if you are nearing your current bandwidth quota to avoid any interuption in service.
If you fail to pay any sums due to us as they fall due, we may suspend your services without notice until full payment has been received.
If you break any of these terms and conditions we may suspend or terminate this agreement without notice.
No refunds will be given for services suspended or terminated due to breach of these terms and conditions or late payment of service fees.
Minimum period payments are final and no refunds will be given on payments for minimum service periods. If you cancel your services with us and have prepaid more than the minimum term payment you will be entitled to a refund of any unused period only. Any refunds will be issued back to the same method of payment as initial payment.
On termination of this agreement or suspension of the services we shall be entitled immediately to block your web site and to remove all data located on our servers.
All conditions and warranties relating to the services supplied under this agreement, whether expressed or implied by law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded. Nothing in these terms and conditions shall exclude our liability for death or personal injury resulting from our negligence. Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the services shall be limited to the charges paid by you in respect of the services which are the subject of any such claim. In any event no claim shall be brought unless you have notified us of the claim within one year of it arising. In no event shall we be liable to you for any loss of business, contracts, profits or any other indirect or consequential or economic loss whatsoever.
Any notice to be given by either party to the other may be sent by either email, fax or recorded delivery to the address of the other party, and if sent by email shall unless the contrary is proved be deemed to be received on the day it was sent or if sent by fax shall be deemed to be served on receipt of an error free transmission report, or if sent by recorded delivery shall be deemed to be served two days following the date of posting.
